Defining Parental Abduction: The Facts in this Case

Parental Abduction is defined as the taking or keeping of a child by a family member,
where the taking or keeping involved some element of concealment, flight, or
intent to deprive a lawful custodian indefinitely of custodial privileges.

Some of the specific definitional elements in this case are as follows:

Taking: The children were taken by their mother to Brasil without their
father's knowledge or permission. The mother never told the children's
father she was going to take the children to Brasil.
Keeping: The children were not returned or given over by their mother
in violation of 2 custody orders issued by a Florida Judge. The mother
ignored court orders issued on March 26th, April 13th and July 24th.
Concealment: The mother concealed the taking and whereabouts of the
children with the intent to prevent return, contact, and visitation.
Flight: The mother transported the children from Florida to Brasil for
the purpose of making recovery more difficult.
Intent to deprive indefinitely: The mother has indicated an intent to
prevent contact with the children on an indefinite basis and
to affect custodial privileges indefinitely.
Children: The 3 abducted children were all less than 5 years old.

Family abducted children are typically thought of as simply one subcategory of
missing children; yet, in reality, family abductions are part of a larger
problem. It is possible for a child to have been unlawfully removed from
custody by a family member, but for that child's whereabouts to be fully
known. Thus, a child can be abducted, but not necessarily missing.

In this extreme case, there exists a situation in which 3 children were abducted
by their mother and apparently taken to the mother's parents home in Sao
Paulo, Brasil, and the mother simply refuses to return the children.
And even worse, the mother and her parents refuse to let the
children's father even contact his children over the phone.

It is a known fact that, when abducted children grow up, they abandon their
parental abductor, and return to the left-behind parent. Parental abductors
are destined to eventually lose their children and be alone forever.
