Giving the GET: The Jewish Divorce in this Case


"When a man marries a woman or possesses her, if she is displeasing to him or if
he has evidence of sexual misconduct on her part, he shall write her a bill of divorce
and place it in her hand, thus releasing her from his household. When she thus leaves
his household, she may go and marry another man."
(Deuteronomy 24:1-2)

In a case where a Jewish man is divorcing a Jewish woman, getting a civil divorce is
not the end of the story. After the civil divorce has been granted, the Jewish man is
then obligated to give a Jewish bill of divorce, known as a GET, to his wife. Without
this GET, the Jewish woman cannot get re-married according to Jewish Law.

Normally, giving a GET can be done in one hour. But sometimes there are complications.
Sometimes a man will "punish" his former wife by refusing to give her a GET. A woman
who cannot get a GET is called an Aguna, as she cannot get re-married again. In this case
something interesting happened. The man wanted to give the GET, but the woman was
refusing to receive the GET! It took more than 6 months until she accepted the GET!

In order to better understand how crazy it is that a woman would refuse to receive a GET,
it is important to understand a few basic related principles in Jewish Law. For example,
a Jewish man can get re-married, even if he did not give the GET to his wife. So what
would a woman win by refusing to accept her GET? This is indeed one crazy woman!

In a case where the man and woman live in different cities and cannot meet in the same
place for the GET giving ceremony, a messager is appointed, so that he takes the GET
given by the man to the location where the woman is living, and then the GET is
delivered to the woman at that location. In this case, the GET was given by the man
in Miami Beach, Florida, and was received by the woman in Sao Paulo, Brazil.

Another requirement of giving a GET, is that the Rabbis handling the giving of the GET
procedure must be highly trained, qualified, and certified by the Israeli Rabbinate in
Jerusalem. Otherwise, the GET will not be valid. Not any Rabbi can do this procedure.

As soon as the civil divorce was finalized, the left behind parent contacted Smadar Hameiry by email,
sent her all the divorce documents, and told her that since they are now legally divorced,
he would now like to give her the GET. He asked her to please check the name of the Rabbi
in Brazil who can accept the GET given in Florida, and deliver it to her in Brazil.

Instead, Smadar Hameiry contacted 2 unqualified Rabbis in Brazil and told them that her
husband was refusing to give her the GET and that he needed to be convinced "by force".
After a few phone calls beetwen Brazil and Boca Raton, the Rabbis in Brazil who wanted
to "assist" Smadar Hameiry in getting the GET, understood that Smadar Hameiry was
completely crazy, and that she made up the whole story. They also understood
that Smadar Hameiry "forgot" to tell them that she had abducted the children.

Eventually, the left behind parent had to call the Israeli Rabbinate in Jerusalem and ask for the
name and contact information of the Rabbi who was in charge of conducting the GETs in
Sao Paulo, Brazil. He contacted this Rabbi to confirm the information, contacted the
Florida Rabbi in charge of the GET, and got the GET process started.

In Florida, the left behind parent was asked to pay a small administrative fee in order to pay for the
services of the Rabbi, the 2 witnesses, and the Sofer (scribe) writing the GET. He was told
that even if he would not pay this fee, the GET would still be written because they have a
religious obligation to do so. the left behind parent paid this administrative fee in full.

After the Rabbi in Brazil received the GET, he contacted Smadar Hameiry who came with her mother,
and her mother told the Rabbi that they couldn't pay the small administrative fee required to
receive the GET, because they didn't have any money. The Rabbi in Brazil understood that
the left behind parent wanted very much to give her the GET, so he called him and told him that
Smadar Hameiry and her mother did not have any money to pay for the GET and that if
he would like to pay for this as it would be considered giving Tzdaka (charity).

But that's not all, because Smadar Hameiry was refusing to accept the GET, the left behind parent
contacted her friends, emailed them the civil divorce documents and told them that he
wanted to give her the GET but that Smadar Hameiry was refusing to accept it. Her
friends called her and asked her if she was completely crazy or what. How is it
possible that a man wants to give a GET and a woman is refusing to accept it?

Smadar Hameiry finally accepted the GET on March 20, 2008, exactly one year after
she abducted the children to Brazil. After delivering the GET, the Rabbi in Brazil
spoke to the left behind parent to inform him that Smadar Hameiry had finally accepted
the GET, although she appeared to be extremely angry when she did so, and
Mazal Tov (congratulations) for getting rid of this crazy woman.
